by Jose Martin of Richards Lindsay & Martin, LLP

A Thorough Overview of Legal Issues and Practical Tips on Manifestation Determination Reviews (MDRs) Under the IDEA Legal MDRs for Special Education and 504

This session will review the MDR requirement and most recent cases. Subtopics to be covered will include procedural requirements, data to consider, special circumstance offenses, MDRs under Section 504, parents’ rights, “stay-put” rule, functional behavioral assessments (FBAs) in relation to MDR decisions, and timeline requirements. The session will also address difficult issue topics: students suspected eligible, whether additional disabilities must be considered, the “impulsivity” argument, assertions of new disabilities after the disciplinary offense, MDR disagreements among school staff, properly completing forms, and handling claims of failure to implement the IEP. The presenter will share effective practices and questions to ask as part of MDRs, as opposed to common misconceptions about the relationship of behavior and disability.
