A Thorough Overview of Legal Issues and Practical Tips on Manifestation Determination Reviews (MDRs) Under the IDEA Legal MDRs for Special Education and 504

This session will review the MDR requirement and most recent cases. Subtopics to be covered will include procedural requirements, data to consider, special circumstance offenses, MDRs under Section 504, parents’ rights, “stay-put” rule, functional behavioral assessments (FBAs) in relation to MDR decisions, and timeline requirements. The session will also address difficult issue topics: students suspected eligible,whether additional disabilities must be considered, the “impulsivity” argument, assertions of new disabilities after the disciplinary offense, MDR disagreements among school staff, properly completing forms, and handling claims of failure to implement the IEP. The presenter will share effective practices and questions to ask as part of MDRs, as opposed to common misconceptions about the relationship of behavior and disability.

Resolving Special Education Disputes Without Litigation
This session addresses the unique nature of special education disputes, and offers tactics and strategies to resolve them without resorting to litigation, including tips on avoiding disputes, strategies for resolving cases informally with unrepresented parents, and dealing with situations where parents are represented by attorneys. In addition, the session will address useful negotiating strategies, approaches and helpful ideas to negotiating settlement terms, making offers of settlement, understanding the mediation process, and tips on working with the mediators and your school attorneys.

Important Session Information:


This session will consist of two topics presented in two 2.5 hour virtual sessions on July 16th, one topic in the morning, and one in the afternoon. A Zoom link and handouts will be sent to participants 2-3 days prior to the session. This session is presented in real time and will not be recorded.
