Manifestation Determination Reviews: Making Data-based Decisions




At specific times, and for certain violations of the student code of conduct, IDEA’s discipline procedures require school systems to conduct what is known as a “manifestation determination review.” The purpose of this review is to determine whether or not the child's behavior that led to the disciplinary infraction is linked to his or her disability.  

However, this review is often a portion of a larger process, and as such, it is necessary to understand what steps to take and how to proceed in order to safeguard the student's right to free and appropriate public education (FAPE). Determining whether a behavior is actually a manifestation of the student’s disability can be a very difficult endeavor!  

Attend this workshop to learn how to make manifestation decisions in a systematic and data-based method.  We will begin with a quick overview of Federal and State legal mandates regarding MDRs.

The majority of our time will be spent on a review of a framework for how to collect data and make data-based manifestation decisions.  Case studies will be used to practice the application of the process.  Useful documents will be provided to support implementation.
